This Distance Sales Agreement ("Agreement") governs the terms under which the user ("You", "User", or "Customer") purchases digital services and products from AdCraft ("Company", "we", "us", or "our") via remote means (e.g. online). This Agreement complements and is integrated with our Terms of Service and Privacy Policy.

1. Definitions

Digital Products / Services: Refers to items such as subscription plans, credits, advertisement generation tools, video rendering, or software modules delivered electronically.

Order / Purchase: The act of selecting a product or service via our website, accepting the terms, and completing payment.

Activation / Delivery: The moment at which the digital product or service becomes available for your use (e.g. access granted, software unlocked, credits added).

Withdrawal Period: The legal window during which you may cancel an order under consumer protection regulations, if applicable.

2. Scope & Applicability

  • This Agreement applies to all purchases made remotely via the AdCraft website or associated digital channels.
  • It is valid for both domestic (Turkey) and international users, to the extent permitted by relevant laws (such as KVKK, Turkish Consumer Protection Law No. 6502, GDPR, and applicable international consumer statutes).
  • It does not apply to physical goods, or to orders manually executed outside the digital platform.

3. Order and Conclusion of Contract

To place an order, you must:

  • Select a digital product or service,
  • Provide required account and payment information,
  • Explicitly accept this Distance Sales Agreement, the Terms of Service, and Privacy Policy,
  • Submit payment.

Once the payment is authorized and accepted, the contract is concluded, and we reserve the right to refuse or cancel orders in exceptional cases (e.g. fraud, incorrect pricing, or technical issues).

After contract conclusion, activation/delivery is generally immediate for digital services.

4. Right of Withdrawal & Cancellation

Under Turkish and European consumer laws, you may have the right to withdraw from the contract within 14 days without giving a reason, counting from the date of contract conclusion (for services that have not yet been activated).

However, this cancellation right does not apply once the digital service is fully or partially activated or delivered, if you have expressly consented to immediate performance and recognized that you lose the cancellation right upon activation.

To exercise the right of withdrawal (only if applicable), you must notify us via email (info@pacetech.co) within the withdrawal period, providing:

  • Your name and registered email,
  • Order invoice or reference number,
  • A statement of your intention to withdraw.

Upon valid withdrawal, we will refund the total amount paid through the same payment method within 14 business days.

5. Exceptions & Non-Refundable Cases

You acknowledge and agree that withdrawal and refunds are not permitted in these cases:

  • When you have accessed, used, or downloaded the digital service, media, or content (e.g. generated video, published ad).
  • When the service has begun with your explicit consent before the end of the withdrawal period.
  • In the case of non-refundable promotional packages, discounts, or credits.
  • When your account is suspended due to breach of Terms of Service.

6. Payment, Fees & Renewals

  • You may pay via credit card, bank transfer, or other supported payment methods. All transactions are processed securely through third-party payment gateways.
  • Subscription services may auto-renew unless canceled prior to automatic renewal.
  • You may cancel auto-renewal via your account settings or by contacting us at info@pacetech.co.
  • Refund is not available after a renewal period has begun and the service is accessible.

7. Performance & Delivery

  • Digital products or services are delivered electronically — there is no physical shipment.
  • The service becomes available immediately upon contract conclusion, unless technical or verification delays occur.

8. Force Majeure & Interruptions

We are not liable for failures or delays due to causes beyond our control (e.g., natural disasters, internet outages, third-party platform disruptions).

If the service is unavailable for more than 72 consecutive hours due to internal faults, you may request remedy via:

  • Refund, or
  • Equivalent credit compensation.

9. Liability & Warranty

  • We warrant that the services will be provided with reasonable care and skill.
  • We disclaim liability for indirect or consequential losses, except where required by law.
  • Where applicable, you may have statutory consumer rights that cannot be waived (e.g. under Turkish Consumer Protection Laws or EU directives).

10. Governing Law & Dispute Resolution

  • This Agreement is governed by the laws of the Republic of Turkey and applicable international consumer protection laws.
  • Any disputes will be handled in consumer arbitration committees or courts in Istanbul, Turkey, unless otherwise required by law.
  • International users may also have rights in their own jurisdictions under applicable consumer protection laws.
